The Default Story

Legally, a default occurs the first time you fail to make a payment when it is due. But if you fail to make your student loan payment for 180 days, your loan will enter the “official” default status and take on a life of its own. This is the point at which the lender will report your student loan as defaulted to the credit bureaus. It is also the point at which a long list of bad things can start to occur. Your tax refund checks can be seized and your wages can be garnished.

What Happened?

Why are student loans so different from all other debts? Well, prior to 1991 the U.S. Department of Education was empowered to collect delinquent student loans for only six years. But in 1991 an amendment to the Higher U.S. Department of Education Act lifted all time limits for collection. And the amendment was retroactive; student loans that were past the statute of limitation for collection prior to the amendment became collectable again. And to further reinforce the longevity of student loan debt, a 1998 change in federal law made it virtually impossible to discharge student loan debt in a bankruptcy.

The Reason for All This

The theory behind making sure that student loan debt can be collected forever is simple; the cost of student loans can be kept low by minimizing the number of borrowers that don’t repay. And since education, and the availability of low cost education loans, is always a political priority, it was not all that difficult to enact these changes.

The Ultimate Collectors

There is simply no way to escape the U.S. Department of Education and their army of private collection agencies that collect on their behalf. In addition, Sallie Mae, the nation’s largest student loan lender, has been purchasing collection agencies to track you down. So, what if they find you and you say you have no money? Well, the U.S. Department of Education now has the right to garnish wages, grab your tax refunds, and even seize your Social Security Checks (you read that right!), all without a court order. And, although Sallie Mae does not wield the same powers, they have started to turn over hard cases to the U.S. Department of Education to get the job done. Anyone attempting credit repair must realize that student loans must be dealt with head on, and the sooner the better.

Credit Repair Options

There are two great solutions that are designed to solve all of your student loan problems. Both of these options can stop all collection activity, lower your interest rate and payment, and reinstate your right to borrow more money for school (in case you want to go back to school). There are no qualification requirements and you are not punished for having bad credit. Everyone gets the same low interest rate. These two options are consolidation and rehabilitation. Both are a good fit with any credit repair process.

Student Loan Consolidation

Just contact the lender or collector and tell them that you would like to consolidate your defaulted loans. You will be required to make three monthly payments on time. Once you have done this you will qualify for consolidation. If you are attempting credit repair you should note that after consolidation your credit report will be updated to show the consolidated status, but the default notation will remain, like most derogatory information, for seven years. If you are in a rough patch the consolidation program allows for up to three years forbearance. Ask your lender for details. My focus has been on defaulted student loans, but it may be handy to note that you do not need to be in default to enjoy the benefits of consolidation.

Rehabilitation

This is a slightly longer process, but has the extra benefit of removing the default status notation from your credit report. To rehabilitate your loan you need to make nine to twelve consecutive on-time payments (depending on which type of student loan you have). Once you have completed this process your loan is considered “seasoned” and is sold to a new lender, and the default is wiped off of your credit. Once done, it is like it never happened. If you are attempting credit repair you should note that your payment history, including any late payments that you made, will remain, but your credit score will benefit from the removal of the default. Borrowers are allowed to rehabilitate a defaulted student loan one time only. As always, contact your lender to discuss the details.

This may cost the borrower a few postage stamps, but the cost is a lot higher with the creditor. Eventually, the creditor decides not to respond to the credit agency, and a 'credit deletion' occurs. This would be a normal Credit Repair result.

Many items are generally deleted in the first round of disputes. One of the top reasons is that these accounts are marked as 'paid', and the creditors are losing money by re-reporting you. This is why a lot of 'Credit Repair' agencies go after 'paid/closed' accounts.

Another top reason, is that judgments/bankruptcies are being reported by the local/state/federal government. The federal government normally holds records for 2yrs before storing the record. When they receive an investigation notice (from the Credit Agency), they normally disregard it or take longer than the allotted time to re-report. (30days)

Remember that the Credit Agency will perform your 'request' if the creditor doesn't respond in 30days. If you 'request' deletion, they will go ahead and delete the item. You will need to look at all items on your credit file (positive/negative), before making a decision in how you would like the Credit Agency to respond. Make sure to compare the credit items on your credit report before disputing any items.

These helpful factors can help you dispute effectively:

1. When the account was open
2. When the account was first/last reported
3. Last account activity date
4. Original Creditor or Collection Company
5. Duplicates with different companies for same account.
6. Hard credit inquiries
7. Transfer/Sold/Paid dates
8. 1st Delinquency date.

One of the foolish mistakes a Credit Repair agency may make is attempting to delete an item (from the original creditor), because of late payments. What they're not realizing is that if the account is 'closed' or has been inactive for a while, the original creditor is less likely to respond back to the Credit Bureau. This will result in a 'deletion' of a credit item in your 'credit history'. They should be requesting 'payment history validation' to result in 'NEVER LATE' on your credit report. Collection, bankruptcy, and lien items cannot be used for this tactic.

When it comes to answering this question, be truthful. You cannot lie about this and get away with it. Just be honest about it and understand that many renters get credit lines just as home buyers do. One caveat to this is that if you are in the works of moving from renter to owner you may want to wait until you have closed your home buying deal before applying for a new credit card.

Employment is another question that is usually asked of applicants. Again, do not lie about this. If you are unemployed and have no other source of income hold off on the application until you find work. If you believe your monthly income is too low, find a part time job so that you can include that added income in the household financial information that they are sure to ask about on the application.

Speaking of household income, this is yet another of the most popular questions asked on credit card applications. This is one of the most important questions on the application and much will be decided based on the answer you give.

Some companies have a minimum annual household income. If you fall below this amount you will be denied. It is that simple. Often you can find this cut off amount on the application itself so look for it.

Annual household income includes anything that brings in money to the home. If you have income from stock dividends, income from part time jobs or other sources include that on the application. It is not a good idea to make up sources of income but do include the income that you honestly receive. If you are on the short list for a raise at work, wait until you get that raise before submitting your application.

Keep in mind that aside from approving or denying the application, your household income amount is also used to determine the credit limit that the company will give you. The more income you can state on the application, the higher your credit limit will be (in most cases).

The last thing you should do in your pre-application process is reduce your debt as much as possible. If you can pay off some loans, do so. Even if the loans are small, paying them off shows the credit card company that you are financially astute.

Identity theft means that someone uses your personal identifying information, like your Social Security number, or credit card number, without asking you, to commit fraud.

If you are a victim of identity theft, you are to put a fraud alert on your credit reports and review them. A fraud alert is something that credit bureaus attach to your credit report. First of all, you are to speak to the fraud department of one of the main credit bureaus (Transunion, Equifax, and Experian) to place a fraud alert on your credit file, plus a victim's statement asking that creditors call you before granting credit or other services.

Victim statements may cause delays in getting credit while the creditors try to contact you. When you open a credit account by getting a new credit card, the lender will contact you to make sure that you really want to open a new account.

Fraud alerts help to prevent an identity thief from opening new accounts in your name. When the credit bureau proves your fraud alert, it will contact the other two. So they will place an alert on their versions of your report, too. If you are not asked, the credit account wouldn't be opened.

It should be mentioned that it's up to you what kind of fraud alert to choose.

If you have chosen initial alert, it will remain on your credit reports for 90 days. While the alert is on your file, perhaps you won't be able to get instant credit. When you file an alert, you will be eligible for a free credit report from each of the three credit reporting agencies.

As far as extended fraud alert is concerned, it will remain on your credit file for seven years. However, you can ask to remove the fraud alert before seven-year period run out. The only thing you need is to make this request in writing and provide information to confirm your identity. These procedures are planned to prevent criminals from removing fraud alerts from victims' accounts.

A fraud alert provides some protection against identity theft, but not in all cases. It will not help you when an identity thief uses your existing credit cards or other accounts. And it will not help you when an identity thief opens new accounts in your name that do not require credit check.

So, identity theft is very serious. Many victims of identity theft spend much money and time repairing damage to their good name and credit score.

With so many different financing options out there, it's difficult to tell if a credit card is right for you. But, with a little bit of know-how, you will have no problem figuring out what to look for in a credit card. Use these basics to separate the bad from the good!

The very first thing you should look at is the interest rate. This is probably the most important factor in selecting a card. This is the rate that the card company will charge you every dollar that you spend on that card. Now, many companies have low rates, but you have to have good credit in order to qualify for that rate. If you're a person with bad, or no credit, then you may not get the low rate that is advertised. Make sure you are aware of that up front.

So what's a good rate? Well, it all depends on your credit. If you have a good credit history, you can expect to qualify for the better rates...typically between 8.9% and 13.9%. Some may offer you a rate even lower than that! If you have "less than perfect" credit, or no credit history at all, you may have to settle on a higher rate for a while until you can prove to the card company that you are a responsible customer who pays their bills on time.

Now, just because you have bad/no credit, that doesn't mean you should have to have a rate in the 20's. I wouldn't go any higher than around 15 or 16 percent. Once you establish a little credit, pay your bill on time, then you can request your rate to be lowered. All you have to do is call the credit card company!

Another important aspect in what to look for in a credit card, is the "introductory rate". This is often used as "bait" to lure people into getting these cards. BEWARE of this! The introductory rates are usually very, very low...sometimes even 0%! However, this period will end, and typically your rate will go up into the high teens or low 20's. That's pretty high, so you should read the fine print before applying for any card with a "to good to be true" rate! Many people get burnt by the low introductory rates, so don't let it happen to you!

Here's one more important aspect in what to look for in a credit card: Incentives! Most, if not all credit card companies offer rewards such as airline miles, cash back, gas etc. Again, these could be used to lure people into a bad rate, so be careful. Rewards are great, but not at the expense of having to pay 20% interest on your purchases. Be smart, and weigh the pros and cons of cards like these that offer rewards.

Now you know some of the basics of what to look for in a credit card. Shopping around for different options is your best bet...and there's many out there. Don't be afraid to apply for multiple credt cards from different finance companies to see which one offers you the most incentives, or the lowest interest rate.

Deciding which credit card is right for you can be confusing. But, if you do your homework, read the fine print, and don't get sucked in by a "to good to be true" offer, you will save yourself A LOT of money in the long run.
